Terms of Use

These Terms of Use govern access to and use of the HERITA platform, published by Famistore Inc., Montreal, Quebec, Canada.

By creating a HERITA account, you accept these Terms of Use without reservation.

Access to HERITA is reserved for adults (18 years of age and older) for creating a Guardian account. Minors may be added to a family space by an adult Guardian.

HERITA reserves the right to suspend or delete any account in the event of a violation of these Terms of Use.

To access HERITA's services, you must create an account by providing a valid email address and password. You are responsible for keeping your credentials confidential.

You agree to provide accurate information and to keep it up to date.

HERITA can be started without payment. Paid levels let your Family Home grow in capacity, organization, and depth. Growth is what's limited — never the memory already entrusted to HERITA.

Payments are processed by Stripe (card) or Flutterwave (African markets). Subscriptions renew automatically unless cancelled before the renewal date. No refunds are issued for the current billing period, except where required by law.

The content you upload to HERITA (photos, videos, documents, recordings, biographies) remains entirely yours. HERITA claims no ownership rights over your content.

You grant HERITA a limited, non-exclusive license solely for the technical purposes of storage, backup, and delivery in accordance with your instructions.

HERITA Editions orders (Family Book, printed Family Tree) are products distinct from subscriptions. All orders are final once payment is confirmed.

Delivery times are estimates. In the event of a manufacturing defect, HERITA commits to remaking the order or refunding the customer.

You may cancel your subscription at any time from your settings. Access to the service continues until the end of the paid period. Your data is retained under the free tier, or its deletion can be requested via HERITA's Contact page.

HERITA may suspend or delete an account in the event of a serious violation of these Terms of Use, after a formal notice has gone unanswered.

HERITA commits to keeping the platform available 99.5% of the time on an annual basis. In the event of prolonged unavailability, HERITA commits to informing users as soon as possible.

Famistore Inc. shall not be liable for indirect damages resulting from use or inability to use the platform, nor for the loss of content due to an event of force majeure.

The processing of your personal data is governed by HERITA's Privacy Policy, available at www.herita.life/confidentialite, and by the Guardian's Oath. These documents form an integral part of these Terms of Use.

HERITA reserves the right to modify these Terms of Use at any time. Users will be notified of any substantial change by email at least 30 days before it takes effect.

Continued use of the service after notification constitutes acceptance of the new Terms of Use.

These Terms of Use are governed by Canadian and Quebec law.

Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Montreal, Quebec, Canada.
